These following terms and conditions apply to persons who access or use the Program both as a merchant (“us” or “Merchant”) and as an affiliate (“you” or “affiliate”) who refer customers to use the Program or services from a merchant.

By participating in the Program, Affiliate agrees to use the Program as defined in and is bound by these Terms. If you do not agree to these Terms in their entirety, you are not eligible to register as an Affiliate or participate in the Program in any way.

1. Approval or rejection of registration

We reserve the right to approve or reject registration for ANY affiliate program in our sole and absolute discretion. You will not have any legal recourse against us if your affiliate program registration is rejected.

2. Affiliate links and coupons

The affiliate link is automatically generated, but you can also create an affiliate link for a specific product or collection. If a person clicks on someone else's referral link and then clicks on your link, yours is what counts.

An affiliate may or may not be assigned one coupon code, the details and usage of which are specified in the control panel. If a customer both clicks on an affiliate link and uses a coupon code, you won't get paid twice. If you are not assigned a branded coupon, you are not allowed to promote the coupon.

Affiliate may also advertise the merchant's website on online channels like Facebook, Instagram, etc., or offline ads in classified channels, magazines and newspapers.

3. Commission fee and payments

Refer each customer to buy on our website, you will receive a commission calculated based on the commission structure. The size of the commission depends on the value of the order and does not include additional fees (tax, shipping costs, etc.).

In order for the affiliate to receive the commission, you need to specify the payment details in the settings. The payment schedule is informed on the affiliate guide page.

Payments are sent only for successfully completed transactions. The affiliate program is subject to the Fair Use Policy, which gives the merchant the right to review each referral order. Commission status, if displayed on the "Commission" tab, all paid commissions will be displayed on the "Payment" tab. Transactions that result in refunds or refunds will not be paid out.

4. Marketing tool

We may share promotional media with you, such as a banner, logo or advertisements for a specific collection, using the Marketing Tool tab. You can download media or get an HTML embed code to share on affiliate channels. You can keep up to date with advertising campaigns by joining the Discord channel, the subscription code of which will be sent to you by e-mail

5. Network

When the "Network" tab is activated, an affiliate can invite others to become affiliates of their downline. When a downline affiliate brings an order to a merchant's store, the upline affiliate also receives network fees, which depend on the merchant's settings.

Share a network link to invite other affiliates into the system and any other affiliate who clicks on that link and signs up will become a downline affiliate.

6. Cookie

We use a cookie to track people who have clicked on your link, so they need to be using cookies for us to track them.

If a person doesn't allow cookies or clears their cookies then we can't track them so can't pay earnings on that person's activity.

Cookies day is said on the Affiliate registration form. The tracking day will start from the time a customer clicks on the affiliate’s link or use the coupon. Within the cookie time, every order made by this customer at merchant website will automatically result in commissions to the affiliate (There’s no need for the customer to click on the affiliate link then).

7. Consistency Removal from Affiliate Program

If the affiliate company wants to leave the affiliate program, it must be contacted via e-mail: info@haip24.ee.

This UpPromote Affiliate Marketing System Privacy Policy describes how we may collect and use personal data and the rights granted to merchants, affiliates and customers in relation to that data.

By joining the affiliate program, you confirm that you agree to the terms and conditions set forth in this privacy policy and other terms. If you do not agree to this Privacy Policy, you may not use the Affiliate Marketing System.

We may update this Privacy Policy from time to time to reflect, for example, changes in our privacy practices or for other operational, legal or regulatory reasons. By continuing to use our affiliate program after these changes are posted, you agree to the revised policies.

Controller of personal data

UpPromote (the controller) stores and controls all personal data provided to UpPromote or collected under this privacy notice.

Information collected from merchants

When a merchant uses the App, we automatically access certain types of information from your Shopify account, such as email address, first name, last name, store information (store domain, store currency, store address, etc.). We collect this information to provide you with our services; for example, to verify your identity, to contact you, to provide customer support when you contact us, to provide you with advertising and marketing activities.

Information Collected from Affiliates

When an affiliate registers to join the program, we collect certain information to notify merchants, such as email address, personal information, payment details and social network information... This information helps the merchant evaluate the background and potential of the affiliate and the specific activities of the process. in the app and contact the affiliate if necessary.

Information collected from customers when they visit a merchant's website

To track a referral order, when customers visit a merchant's website and make a purchase, the UpPromote system collects information about the order, such as total order, order items, order ID....

Information sharing

Ensuring your privacy is important to us. We do not share your personal information with third parties except as described in this Privacy Policy. We may share your personal data with third-party service providers that we use to process specific functions; examples include the provision of email marketing, data analysis and other marketing support,... Third-party service providers have access to personal data only when it is necessary to perform their tasks and must process personal data in accordance with this privacy policy.

We may also disclose your personal information to any third party with your prior consent.

Use of UpPromote by children

UpPromote is not intended for children. If you are under the age of 13, you may use the Affiliate Marketing System only under the supervision of your parent or guardian.

Your rights

UpPromote understands that you have rights over your personal information and will take reasonable steps to allow you to access, correct, amend, delete, transfer or restrict the use of your personal information. If you use the system and want to exercise this right, please contact us at info@haip24.ee. We may require you to provide us with acceptable proof of your identity before allowing us access to such information.

If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly - we are the processor on their behalf and can only forward your inquiry to them for their response.
